1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of the website stridevox.com and all related services (collectively, the "Service") operated by:

2. Description of the Service

StrideVox is a web application that allows users to:

• Import fitness and health data from their Garmin account (including but not limited to training activities, sleep data, heart rate, and performance metrics).
• Interact with a large language model (LLM) to receive AI-generated insights about their training, recovery, race preparation, sleep patterns, and general fitness guidance.
• Communicate with the AI assistant via WhatsApp, using Twilio's messaging infrastructure, as an alternative to the web interface.

The LLM functionality may be powered by the user's own API key or by a key provided by StrideVox (which may be subject to additional fees under the premium plan).

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

You must be at least 16 years of age to create an account. By registering, you confirm that you meet this age requirement.

4. Freemium Model and Payments

The Service is offered on a freemium basis:

• Free tier: Access to core features, subject to usage limits as described on the website.
• Paid plans: Additional features, higher usage limits, or LLM access provided by StrideVox may be available for a recurring subscription fee.

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record. Paddle handles payment processing, invoicing, and VAT/sales tax on our behalf. Your payment-related contractual relationship is with Paddle.

Prices are displayed on the website and include applicable taxes unless stated otherwise. We reserve the right to modify pricing with at least 30 days' notice. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with our Refund Policy and applicable Swiss and EU consumer protection law.

5. User-Provided API Keys

If you choose to provide your own LLM API key:

• You are solely responsible for complying with the terms of your API key provider.
• StrideVox transmits your key to the relevant LLM provider solely to process your requests. We do not store your API key beyond the duration necessary to provide the Service, and we do not use it for any other purpose.
• StrideVox is not responsible for any charges, rate limits, or issues arising from the use of your API key.

6. Health and Fitness Data — Important Disclaimers

AI-generated responses may be inaccurate, incomplete, or inappropriate for your specific situation. You use any insights at your own risk.

7. Third-Party Services

The Service integrates with third-party platforms, including but not limited to:

• Garmin Connect: Your use of the Garmin integration is also subject to Garmin's terms of use and privacy policy.
• LLM providers (e.g., OpenAI, Anthropic, or others): The AI responses are generated by third-party models. StrideVox is not responsible for the content, accuracy, or availability of these third-party services.
• Twilio / WhatsApp (Meta Platforms): If you use the WhatsApp channel, your messages are routed through Twilio and WhatsApp's infrastructure. Your use of WhatsApp is subject to WhatsApp's terms of service and privacy policy.

StrideVox is not affiliated with, endorsed by, or sponsored by Garmin Ltd., any LLM provider, Twilio Inc., or Meta Platforms, Inc.

8. Data Protection and Privacy

We take the protection of your personal data seriously. Please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your data.

Key points:

• Fitness and health data is considered sensitive personal data under the Swiss Federal Act on Data Protection (nFADP/DSG) and, where applicable, the EU General Data Protection Regulation (GDPR).
• We process this data based on your explicit consent, which you grant when connecting your Garmin account.
• When you submit queries to the LLM, portions of your fitness data may be sent to the LLM provider to generate responses. We minimise the data transmitted and do not send your full data set unless necessary for the specific query.
• You may request access to, correction, or deletion of your personal data at any time by contacting us.

9. Intellectual Property

All content, design, code, and trademarks associated with StrideVox are the property of the operator or its licensors. You may not reproduce, distribute, or create derivative works from the Service without prior written consent.

You retain ownership of the data you import into the Service. By using the Service, you grant StrideVox a limited, non-exclusive licence to process your data solely for the purpose of providing the Service.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or access the source code of the Service.
• Circumvent usage limits, security measures, or access controls.
• Use automated tools (bots, scrapers) to access the Service beyond its intended interface.
• Share your account credentials with third parties.

11. Availability and Modifications

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. For material changes, we will provide reasonable notice where possible.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• StrideVox is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• StrideVox shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid to StrideVox in the 12 months preceding the claim, or CHF 100, whichever is greater.
• Nothing in these Terms excludes liability for fraud, gross negligence, or wilful misconduct, or any liability that cannot be excluded under Swiss law.

13. Termination

You may delete your account at any time through the Service. We may suspend or terminate your account if you violate these Terms, with notice where practicable.

Upon termination, we will delete your personal data in accordance with our Privacy Policy, unless retention is required by law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from or in connection with these Terms shall be submitted to the competent courts at the domicile of the operator, subject to any mandatory consumer protection provisions that grant you the right to bring proceedings in your place of residence.

For consumers residing in the EU, mandatory provisions of EU consumer protection law shall apply insofar as they provide a higher level of protection.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
